1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms of Service, DormSweep's Refund Policy, Community Guidelines, Prohibited Items Policy, and Privacy Policy (collectively, the "Terms"). If you do not agree with any part of the Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and DormSweep LLC regarding your use of the Service.
2. Platform Overview
The Platform is a student-to-student marketplace that allows verified college students to buy and sell items within their campus community. The Platform provides users with the platform, payment processing workflow, messaging system, reporting tools, dispute system, and administrative moderation tools.
DormSweep is not the seller, buyer, owner, manufacturer, distributor, storage provider, or shipper of any listed item. All transactions occur directly and solely between users. DormSweep is not a party to any transaction between users via the Service. We are under no obligation to provide support for the Service.
3. Eligibility
To use the Services, you must:
- Be at least 18 years of age.
- Possess a valid college or university (.edu) email address.
- Create and maintain only one account (accounts are non-transferrable).
- Provide accurate, complete, and current information to create an account.
- Possess the legal capacity to enter into a binding contract under the laws of your jurisdiction of residence.
By using or accessing the Service, you represent and warrant that you meet the foregoing eligibility requirements.
DormSweep may suspend, restrict, or terminate accounts that violate these eligibility requirements or any Terms. DormSweep also reserves the right to require additional verification of student status at any time.
4. Marketplace Fees; Payment Information
DormSweep currently charges a 5% marketplace fee on each transaction completed via the Service. Additional payment processing fees may be charged through DormSweep's payment processor, Stripe. Fees may change in the future and will be disclosed before they are charged. All applicable fees are displayed at the time of transaction.
By providing us with a payment method, such as a credit or debit card, you authorize us, or our third party processor, to charge you the price of the fee, as presented to you at the time of purchase.
5. Transaction Lifecycle
Transactions on DormSweep follow a structured lifecycle. Understanding each stage is important for both buyers and sellers who use the Services.
Stage 1 — Awaiting Handoff
After a buyer purchases an item, the order enters "awaiting_handoff" status.
Buyer Cancellation:
Buyers may cancel the order if the seller has not yet submitted handoff evidence. Upon cancellation, the order is canceled, the buyer is refunded, the conversation is closed, and the listing is returned to the marketplace.
Seller Cancellation:
Sellers may cancel the order before handoff occurs. Acceptable reasons include item unavailability, item sold elsewhere, listing mistake, or emergency situations. Upon cancellation, the order is canceled, the buyer is refunded, the conversation is closed, and the listing is returned to the marketplace.
Admin Cancellation:
DormSweep administrators may cancel any order before handoff when necessary for safety concerns, fraud concerns, policy violations, or Platform or Service integrity.
Stage 2 — Seller Handoff Completed
To complete handoff, the seller must meet the buyer, hand over the item, and submit a required handoff evidence photo through the Platform. After evidence is submitted, DormSweep automatically sends a 4-digit pickup confirmation code to the buyer and the order status becomes "awaiting_buyer_confirmation."
Once handoff evidence is submitted, buyer and seller cancellations are disabled because the item has allegedly changed possession.
Stage 3 — Dispute Window
While the order is in "awaiting_buyer_confirmation" status, the buyer may submit a dispute. Acceptable dispute reasons are set forth below.
DormSweep may request photos, screenshots, messages, or additional documentation from either party. Administrators may review listing content, messages, handoff evidence, reports, submitted evidence, and user history.
Possible dispute outcomes include issuing a refund and canceling the transaction, or denying the dispute and requiring the buyer to complete the confirmation process. DormSweep's determination is final.
Stage 4 — Pickup Confirmation
The buyer enters the pickup confirmation code provided by DormSweep. This action represents confirmation that the item was received, confirmation that the transaction is accepted, confirmation that the meetup occurred, and acceptance of the item in its current condition. The pickup confirmation is the primary transaction acceptance point on the Platform.
Stage 5 — Completed Transaction
Once the buyer confirms pickup, the order status becomes completed. At this stage there are no refunds, no returns, no cancellations, and no new disputes. All sales are final after pickup confirmation. DormSweep cannot independently verify events occurring after users leave the meetup.
6. Significant Discrepancy Standard
The following may qualify for dispute:
- Wrong item received.
- Major undisclosed damage.
- Major differences from listing description.
- Fraudulent representation.
The following generally do not qualify:
- Minor cosmetic wear.
- Subjective dissatisfaction.
- Buyer remorse.
- Small imperfections consistent with listing photos and description.
DormSweep reserves final determination authority on all disputes.
7. No-Show Policy
Buyer No-Show:
If the seller reports that the buyer failed to attend a scheduled meetup, DormSweep may cancel the order, refund the buyer, relist the item, and issue a warning or strike. Repeated no-shows may result in suspension.
Seller No-Show:
If the buyer reports that the seller failed to attend a scheduled meetup, DormSweep may refund the buyer, relist the item, issue a warning or strike, or suspend the seller. Repeated violations may result in account termination.
8. Admin Authority
DormSweep reserves the right to cancel transactions, issue or deny refunds, remove listings, suspend or ban accounts, restrict Platform or Service access, reverse marketplace actions, investigate disputes, and preserve records. This authority may be exercised for fraud prevention, abuse prevention, platform safety, policy enforcement, legal compliance, and marketplace integrity.
9. Prohibited Items
Please refer to DormSweep's Prohibited Items Policy for a full list of items that may not be listed or sold on the Platform. DormSweep may remove any listing at its sole discretion. DormSweep has no obligation to monitor, screen, or verify that any item sold via the Service complies with the Prohibited Items Policy, and such responsibility remains solely with the users.
10. Account Deletion
Users may request account deletion through the Platform. Upon deletion, personal profile information may be removed or anonymized, active listings may be removed, favorites may be deleted, and account access may be terminated.
DormSweep may retain orders, payment records, dispute records, audit logs, fraud prevention records, legal compliance records, and tax and accounting records in accordance with applicable law and our Privacy Policy. DormSweep may also retain records as necessary to investigate fraud, enforce platform policies, resolve disputes, comply with legal obligations, and maintain marketplace integrity.
11. Intellectual Property
Subject to your complete and ongoing compliance with these Terms, DormSweep grants you, solely for your personal, non-commercial use, a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to: (a) install and use one object code copy of any mobile or other downloadable application associated with the Service, if any, on a mobile device that you own or control; and (b) access and use the Service. Except and solely to the extent such a restriction is impermissible under applicable law, you may not: (a) reproduce, distribute, publicly display, publicly perform, or create derivative works of the Service; (b) make modifications to the Service; or (c) interfere with or circumvent any feature of the Service, including any security or access control mechanism. If you are prohibited under applicable law from using the Service, then you may not use the Service.
All content, design, code, trademarks, and materials on the Platform or otherwise accessible via the Services are the property of DormSweep or its licensors.
By posting, uploading, or otherwise submitting content to the Platform, including, without limitation, photos, videos, statements, and testimonials, you grant DormSweep a non-exclusive, royalty-free, irrevocable, perpetual, worldwide license to use, display, and distribute that content for the purpose of operating and promoting the Platform and Services. You must not submit, upload, post, display or share any content that you do not have the right to copy, use or share for the purpose of your use of the Service.
12. Third Party Services and Linked Websites
DormSweep may provide tools through the Service that enable you to export information to third-party services. By using one of these tools, you hereby authorize DormSweep to transfer that information to the applicable third-party service. Third-party services are not under DormSweep's control, and, to the fullest extent permitted by law, DormSweep is not responsible for any third-party service's use of your exported information. The Service may also contain links to third-party websites. Linked websites are not under DormSweep's control, and DormSweep is not responsible for their content. Please be sure to review the terms of use and privacy policy of any third-party services before you share any information with such third-party services. Once sharing occurs, DormSweep will have no control over the information that has been shared.
The Service may include or incorporate third-party software components that are generally available free of charge under licenses granting recipients broad rights to copy, modify, and distribute those components ("Third-Party Components"). Although the Service is provided to you subject to these Terms, nothing in these Terms prevents, restricts, or is intended to prevent or restrict you from obtaining Third-Party Components under the applicable third-party licenses or to limit your use of Third-Party Components under those third-party licenses.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. DormSweep does not warrant that the platform will be uninterrupted or error-free. DormSweep does not, and expressly disclaims any responsibility to, endorse, verify, or guarantee any listing, user, item (including its quality, safety, legality, merchantability, or fitness), or transaction on the platform.
14. Limitation of Liability
To the fullest extent permitted by applicable law, DormSweep and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services or Platform, including but not limited to: item quality or accuracy of listings; failed or fraudulent transactions; physical injuries, theft, or damages arising from in-person meetups; loss of data, revenue, or profits; or unauthorized account access.
To the fullest extent permitted by applicable law, in no event shall DormSweep's total liability exceed the amount of platform fees paid by you in the three (3) months preceding the claim.
15. Indemnification
You agree to indemnify and hold harmless DormSweep and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Platform, Service, your listings or transactions, or your violation of these Terms.
16. Governing Law
These Terms shall be governed by the laws of the State of New York. Any dispute shall be resolved exclusively in the state or federal courts located in New York.
17. Changes to Terms
DormSweep may modify these Terms at any time. Material changes will be posted on the platform with an updated effective date. Continued use of DormSweep after changes are posted constitutes acceptance of the revised Terms.
18. Miscellaneous
18.1 Force Majeure. DormSweep will not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, labor disputes, or failures of third-party service providers such as Stripe.
18.2 Notices. DormSweep may provide notices to you via email, in-platform messaging, or by posting on the platform. You may send legal notices to DormSweep at support@dormsweepco.com.
